eCommerce terms & Conditions

 

These terms and conditions are for the sale of original artworks by the artist Katie Whyte (ABN 72159544310) from the ecommerce platform (Shop) on this website (www.hiwhytey.com) which is owned and operated by the artist and sole trader Katie Whyte.

These terms and conditions of sale apply to all transactions performed on this website. By making a purchase through the online shop on this website, customers are confirming that they have read and understood these terms and conditions and expectations of products and delivery methods described below.

 

PRODUCTS

Artworks sold through this website are one of a kind, original artworks, not a prints or reproductions. The image shown will either be a digital scan or photograph of the artwork. These are presented as accurately as possible although due to the nature of digital imagery, the finish, brightness and colour of items may appear slightly different in person. 

Please read the descriptions of each product, especially the size and medium of artworks show on the website. Many mediums used are of a fragile nature and often not waterproof; these include ink, gouache, pencil drawing and pastel. All artwork will be provided in a temporary plastic bag to protect the front surface during transit. It is recommended that you frame you artwork as soon as it arrives to protect the quality and longevity of your artwork. Avoid using frames that allow the surface of the artwork to come into contact with the glass. Use mount board to create a barrier to prevent the artwork sticking to the glass. Artworks are sold unframed unless specifically noted in the description.

 

The exception to this is original “acrylic paintings on glass”; these are only available in a permanent frame as the frame is a structural element of the artwork and cannot be removed (along with the backing board).

All care is taken when handling artworks prior to sale. Due to the handmade nature of the work, it is expected that studio sale items such as drawing, paintings or sketches may have minor markings on the front or back surface not visible in photographs. The artist will indicate if more obvious markings are present in the products description.

ORDERS

Purchases on the ecommerce platform (shop) are not confirmed until:

  • The order is placed with correct contact details and;

  • The payment has been provided in full be either PayPal or Credit Card and;

  • The artwork has been processed by the artist; this includes confirming delivery or collection details with the customer.

 

Failure to fulfil payment or provide correct contact details may make orders void and items may be returned to the shop for re-sale.

 

DELIVERY

Due to the artist’s regional location, express (same day or next day) deliveries are not available. Australia Post or Pack and Send are used for National and International deliveries. The best delivery method will be chosen for the size and weight of your parcel which is estimated at Check Out.  Please note, parcels are much larger than your items due to protective packaging. Large and fragile items are usually sent by courier using Pack and Send to avoid breakages. 

Customers may be required to retrieve their delivery from nearby courier depots if unavailable at time of delivery. This is outside of the artist control and is a safety measure to prevent your parcel being  abandoned and potentially stolen. A delayed delivery due to these measures is a better outcome than a missing or stolen delivery from your front door. Original Artworks are one of a kind and are not reproduced if lost in the post.

Customers are responsible for the address details and contact details provided with their order. If incorrect details are provided, deliveries will be delayed and an additional shipping fee may be charged. 

 

COLLECTION

Local collection or delivery is sometimes available as a option at check out. Collection is different to delivery and these options are only available when the artists is scheduled to visit metro areas such as Toowoomba, and may be limited during holiday times. 

Local collection is free but must be confirmed via email. Please ensure your contact details are correct on your order and keep an eye out for an email from the artist shortly after you order is placed. Please check your spam folder if you are still awaiting this email after a few days. You must respond to this email to confirm your collection details.

Collections usually take place in a public space in the CBD after a mutually convenient time has been confirmed. Failure to collect your order without exceptional explanation may lead to your order being refunded and returned to the online shop for resale.

 

REFUNDS

Please take the time to read product descriptions for each item you purchase. After the delivery of the artwork, if you are unhappy with your order because it does not match the image or description provided, please get in touch with the artist as soon as possible. Refunds for damaged or soiled items will not be given.

 

INTELLECTUAL PROPERTY

The artist Katie Whyte retains all rights to all artworks displayed and sold through this website. All images, details and descriptions of the artworks remains the intellectual property of the artist.

The artist retains the rights to the artwork, including rights to reproduce or distribute images of the artwork, even after the sale is made. Customers and viewers acknowledge that the intellectual property of all physical artworks, digital images and words displayed on this website belong to the artist and no one else is authorised to copy, share, publish or distribute them.
